The following describes the Privacy Policy in relation to the voluntary information you submit to Spectrumotion. Reference herein to Spectrumotion shall be interpreted to refer to the Irvine Spectrum Transportation Management Association, dba Spectrumotion, all its member organizations and sponsoring organizations.

Consent
By using the Spectrumotion website you consent to the terms of this Privacy Policy and to Spectrumotion’s collection, use, or dissemination of Personal Information (defined below) as described in this Privacy Policy.

You agree that you will not use the site or Spectrumotion’s services for any unlawful activity or in violation of the standards set forth herein.

Information Gathered
The individually identifiable information you voluntarily provide to Spectrumotion such as your first and last name, phone number, e-mail address, home or physical address, business address or other contact or personal information is referred to herein as “Personal Information”.

Personal Information is used by Spectrumotion to provide, maintain, and improve Spectrumotion’s services and to fulfill requests submitted to the Spectrumotion program and may be used to inform you of service information, promotions or other relevant information. Spectrumotion and its contractors will not disclose your Personal Information except as described below, or where disclosure is required by law. Spectrumotion will not sell or otherwise provide your Personal Information for value received.

Spectrumotion will utilize Personal Information for the purpose of implementing and improving the Spectrumotion program and services. This may include, but is not limited to (i) utilizing third-party contractors to provide Spectrumotion’s services; (ii) forwarding e-mails and phone messages related to services provided by rideshare programs, transit agencies, or other public agencies for response by the relevant agency; and (iii) utilizing web-based and telephone technologies to generate usage information and statistics in order to improve the user experience and system performance of the Spectrumotion system.

You acknowledge and agree that your participation in the programs and services offered through Spectrumotion is voluntary and that you are responsible for your participation in any transportation or rideshare arrangement. You understand that Spectrumotion shall have no responsibility or liability for any claims, expenses or damages resulting from any individual’s participation. You understand that the information you provide will only be used as set forth herein.

Security
All Spectrumotion employees and contractors with access to Personal Information are required to adhere to the terms of this Privacy Policy. Personal information we collect online is stored on our server and is not publicly accessible. Personal Information is accessible by Spectrumotion employees and authorized contractors on a need-to-know basis. Once Personal Information is no longer needed, such information is deleted. Phone or e-mail inquiries about another public agency will be forwarded directly to the relevant agency, and any Personal Information will be handled in compliance with said agency’s privacy policy. While Spectrumotion does not warrant or guarantee the security of your Personal Information, it makes all reasonable efforts to maintain such security.

Links to other Websites
When you link to another site, you are no longer on Spectrumotion’s site and this Privacy Policy will not apply. Spectrumotion provides links to other transportation-related websites as a service to our customers. By providing such links, Spectrumotion does not take responsibility for the information contained on those sites.

Waiver of Liability and Hold Harmless
By using the Spectrumotion website or participating in any of Spectrumotion’s programs you hereby agree to waive, release, discharge in advance and hold harmless Spectrumotion, including its directors, officers, employees, agents and affiliates from any loss, damage, claim, judgment or harm that you or anyone for which you have used the information, has suffered in whatever manner or form, and regardless of how the alleged loss, damage or harm is alleged to have been caused. To the maximum extent allowed by law, Spectrumotion, will not be liable for any direct, indirect, incidental, special consequential, or punitive damages (including without limitation any loss of profits, data, use, or goodwill) resulting or relating in any way to your access, participation, or use of (or inability to access, participate, or use)the sites or the services – whether based on warranty, contract, tort/negligence of other legal theory-even if Spectrumotion has been advised of the possibility of such damages. The laws of some jurisdictions may not allow the limitation of liability set forth above, so this limitation of liability may not apply to you. If any part of this limitation on liability is found to be invalid or unenforceable for any reason, the aggregate liability of Spectrumotion, including its sponsoring agencies, under such circumstances for liabilities that otherwise would have been limited shall not exceed one hundred dollars ($100).

Spectrumotion reserves the right to alter, change, add or delete provisions of this Privacy Policy. Any changes will be posted, and Spectrumotion encourages users to review the policy regularly.
